INDOPCO :: essays research papers

The INDOPCO case in 1992 provided some guidelines concerning capitalization for the taxpayer. In the case, the Supreme Court ruled that expenses directly incurred in reorganizing or restructuring a corporate entity for the benefit of future operations are not deductible. The court also held that investment banker fees, legal fees, proxy costs, and SEC fees incurred by a target corporation in a friendly takeover must be capitalized if the takeover produces significant future benefits. The taxpayer would rather expense the costs as this would give them a deduction on their taxes. Capitalizing these costs also increases their income, increasing the amount of taxes they have to pay. Thus, the IRS encourages capitalizing costs whenever there is a question as to what method to use. Originally the taxpayer had more of an advantage because the ruling was left open to much interpretation and the IRS was rather lenient concerning the future benefits. The Supreme Court just said that determining future benefits is undeniably important in determining whether a future expense should be capitalized. There have now been rulings where the IRS has become more aggressive in dealing with future benefits. The IRS realizes that companies will expense anything they can to reduce their tax burden. Even costs that would be incurred while investigating the expansion of a company’s existing business should be expensed if they are connected to an event that produced a significant long-term benefit. The only way they can be expensed is if the acquisition proves to be an unsuccessful one. The INDOPCO ruling also leaves open the question as to what directly incurred means. Companies were left to decide whether to capitalize a cost that was incurred to secure a benefit that extended beyond the current year, even though the transaction was not one in which a specific, identifiable asset was acquired. If it was determined the cost provided a significant long term benefit, the cost was a capital cost, and if not the cost was a period expense. Now, with the additional rulings, the IRS is the ones â€Å"dancing in the street†, because companies are forced to capitalize more costs, bringing in more revenues for the government. I think the decision was a good one in the sense that there needed to be some clarification as to what costs should be capitalized and which ones need to be expensed.

A Woman’s Place Is In The House Essay

A woman’s place is in the house The place of woman was considered to be in the house almost since the beginning of time. Back then, women used to be the only ones responsible for the household and for the bringing up of their children. They lacked of sufficient education, as most of them never finished school and only a minority went to the university. And even if they did acquire a higher education, they scarcely had the same opportunities as men because they were considered inferior. Therefore, they were usually forced to bow their heads and accept the situation the way it was because they didn’t know how to defend themselves and clarify the truth. All this took place up to 1880,when women started to rebel and to demand the equality of rights between men and women. They began fighting for their right to vote, to have the same educational opportunities as men and to be judged by their knowledge and their education and not by their sex. It took them years to accomplish their goals but they finally made it. The emancipation of woman was and still is a fact. However, there still exists a considerable amount of people that believes that a woman’s place is exclusively in the house. This, assuming that the woman is a mother and therefore responsible before the members of her family. But are all women going to marry or be relegated to a life of inaction during their youth or while they remain single? Certainly not. Moreover, a schooled and scientific woman can understand her duties a lot better and is capable of completing them. A mother should know science in order to inspire her children in great deeds and noble sentiments, making them feel superior to the other objects in the universe, teaching them from the cradle to become familiar with the great scenes of nature. And nothing more ideal and sublime than the scientific mother, who goes to spend an evening at the astronomical observatory with her children by the hand to show them Jupiter, Venus, preparing in that way their tender hearts for the most legitimate aspirations that could occupy men’s minds. In addition, a working woman provides financial aid and consequently a larger amount of money can be spent in order to satisfy less essential needs, which will please the members of her family. But there are times when scientific women become indifferent and are not capable of giving tenderness because they are too preoccupied with themselves and become demanding, despotic and vain and do not know how to make a happy home. For them, there are no responsibilities to carry out, only whims to satisfy. Thus, women should find the golden section between the responsibilities before their family and their job in order to be happy and please their family at the same time. Besides, there’s enough time and competence for cooking and mending and a great soul such as that of women, equal to their mates, born to embrace all the beauty that exists in creation of divine origin and end, should not be wasted all on seeing if the plates are clean and the rocking cradle.

Edwards’ sermon Study Essay

1. To whom is the sermon addressed? The sermon is addressed to the congregation. 2. According to Edwards, why is God wrathful? People are wicked sinners, and God’s wrath is infinite and arbitrary. 3. Reread the sixth paragraph. What people, according to Edwards, are not in the hands of this angry God? How is this state achieved? Reading the sermon he claims that, â€Å"Thus all you that never passed under a great change of heart, by the mighty power of the Spirit of God upon your souls; all you that were never born again, and made new creatures, and raised from being dead in sin, to a state of new, and before altogether unexperienced light and life, are in the hands of an angry God,† therefore I infer that the individual whom have passed a great change by heart by, and was born and again and made into new creatures, are not in the hands of this angry god. I believe he conjectures this by isolating it and remaining on the topic of the individuals who are in the hands of the angry God. 4. Figurative language is language that cannot be taken literally since it was written to produce a certain effect. Edwards makes effective use of figurative language as he speaks of God’s wrath. Find three examples of his use of figurative language and explain why they are effective. To convey his sense of tone and attitude, he uses rhetorical techniques, imagery, repetition and metaphors to display his piercing tone. In his sermon he repeats the term â€Å"wrath†, which means intense fury, over and over again creating it vibrant how angry god is with his congregation/people. Edwards is essentially proposing that they are atrocious individuals and deserve to burn in hell. Edwards’ piercing tone is also elated by the metaphors he uses in his sermon. He associates several things to implement his tone. Edwards says â€Å"The wraths of God are great waters that are dammed for the present†¦Ã¢â‚¬  also he states â€Å" The bow of God’s wrath is bent and the arrow made ready on the string, and justice bends the arrow at your heart†¦Ã¢â‚¬  In his metaphors he does not use optimistic undertones, making them harsh and to the concept. In using these metaphors, Edwards is enabling the reader(s) to understand the tone by putting it in a situation and context, which is more easily correlated. Subsequently, he uses imagery in the opening paragraph stating  that when men are on Gods’ hands and they could descend to hell. Natural men are held in the hands of God, over the pit of hell knowing that you might descend into the abyss at any moment should scare you. God chose to save you until he wants to let you slope into an eternity of sweltering flames. 5. Elects or Saints were the ones who were saved and the ones who weren’t were ‘wicked’. 7. Explain how his sermon connects to a concept or theme in â€Å"The Crucible.† They both have a common theme of good vs. evil. Meaning, they mutually belief system into how they should act/live. Edwards leads his message to the Puritan people claiming that they are corrupt and must change their ways, he does this threatening method to attempt to scare them by the description of hell. Similarly, the characters in The Crucible convict each other of committing deeds against God and are very hostile about it, much like Edwards.

Conan Doyle Essay

In the â€Å"The Blue Carbuncle† Sherlock Holmes solves the mystery of a stolen diamond. The criminal in this story is a man named James Ryder. After James Ryder had stolen â€Å"The Blue Carbuncle† he stuck it down a goose’s throat. The goose that had the diamond was distributed the Breckenridge Stall, then sold to a goose club at the Alpha Inn. Sherlock Holmes bumps into James Ryder outside the Breckenridge Stall. Sherlock Holmes makes the criminal confess to what he had done. Sherlock Holmes then lets him go free because he thinks that he will not commit any more crimes, because of how fearful he was. It was quite important for Sir Arthur Conan Doyle to create a strange atmosphere because it adds to the tension. All three stories have strange and unusual atmospheres, but each story’s atmosphere is different. In â€Å"The Red Headed League†, Conan Doyle describes the area of Saxe-Coburg Square. He shows how unpleasant and muddled the area is. â€Å"It was a pokey, little, shabby-genteel place, where four lines of dingy two-storied brick houses looked out into a small railed-in enclosure, where a lawn of weedy grass and a few clumps of faded laurel bushes made a hard fight against a smoke-laden and uncongenial atmosphere. † The words that are used here show the messiness and unpleasantness of the area. The words â€Å"pokey†, â€Å"little†, â€Å"shabby-genteel†, â€Å"dingy† and â€Å"smoke-laden† all give a pretty good idea that the area was quite chaotic. In â€Å"The Speckled Band† Conan Doyle created a thrilling and frightening atmosphere, as if it was a horror story. â€Å"The Speckled Band† was set at â€Å"Stoke Moran† in â€Å"Surrey†, which is where Julia Stoner was killed. At the beginning of the story when Helen Stoner is talking to Sherlock Holmes about her problems she describes how the night was when Julia was killed. â€Å"It was a wild night†, this shows that that night was unlike any ordinary night. â€Å"The wind was howling outside, and the rain was beating and splashing against the windows. † This describes a lot of the atmosphere; it shows that the weather was quite stormy. This also explains why Helen couldn’t sleep. â€Å"Suddenly, amidst all the hubbub of the gale, there burst forth the wild scream of a terrified woman. † Conan Doyle’s intended effect was to thrill the reader; Conan Doyle has achieved this by using the words â€Å"wild†, â€Å"howling† and â€Å"beating†. Here the writer’s effect was to try and scare or thrill the reader. Whereas in â€Å"The Blue Carbuncle† the atmosphere was a little different. â€Å"It was a bitter night†. Here, Conan Doyle is trying to show the reader that it is cold outside. He achieves this by describing the night as â€Å"bitter†. The reader will also know that it is cold because Holmes and Watson both put on their â€Å"ulsters† and â€Å"cravats†. â€Å"Outside, the stars were shining coldly in a cloudless sky†, here Conan Doyle is trying to show the reader that the area is very calm and peaceful, unlike in â€Å"The Red Headed League† where the area is busy and unpleasant. Sir Arthur Conan Doyle used different ways to show that these stories take place in the 1880’s and 1890’s. Most of the time he mentions â€Å"carriages†, which were used in that time. Nowadays carriages are not used because they have been replaced by cars. In â€Å"The Red Headed League† when Sherlock Holmes is memorising all the shops at Saxe-Coburg Square he comes across a shop that makes carriages. â€Å"McFarlane’s carriage-building depot†. Here the writer intended to show the reader that this was a time where carriages were used as a form of transport. The effect on the reader is that the reader knows this story is set in the 1890’s. Conan Doyle also uses dates and newspapers to show that these stories are set in the 1880’s and 1890’s. In â€Å"The Speckled Band† and â€Å"The Red Headed league† Conan Doyle mentions the date, but he does not mention the date in â€Å"The Blue Carbuncle†. In â€Å"The Speckled Band†, right at the beginning of the story while Dr. Watson is narrating, he says â€Å"It was early in April, in the year ’83†; hear the writer is showing the reader that this story is taking place in the year 1883. In â€Å"The Red Headed League†, the note that Jabez Wilson shows to Sherlock Holmes had a date on it. The note said, â€Å"THE RED-HEADED LEAGUE IS DISSOLVED. October 9, 1890. † Also when Mr. Wilson is showing Sherlock Holmes the advertisement he mentions the date on the newspaper. â€Å"It is The Morning Chronicle of April 27, 1890. Just two months ago. † By saying that the newspaper was from two months ago, Conan Doyle is telling the reader that this story was set in 1890. Conan Doyle did not always use the same techniques, to show that each story was set in the 1880’s and 1890’s. Unlike â€Å"The Speckled Band† and â€Å"The Red Headed League†, in â€Å"The Blue Carbuncle† there are no dates to show that the story is set in the 1880’s and 1890’s. Conan Doyle uses different techniques to show that this story is also set in that time. In â€Å"The Blue Carbuncle† and â€Å"The Red Headed† Conan Doyle refers to gas-lit lamps, as gas lamps were used in the 1880’s and 1890’s. In â€Å"The Blue Carbuncle† when Sherlock Holmes and Dr. Watson were jus about to leave the Breckenridge stall, Watson narrates â€Å"Turning round we saw a little rat-faced fellow standing in the centre of the circle of yellow light which was thrown by the swinging lamp. † He also says, â€Å"He sprang round, and I could see in the gas-light that every vestige of colour had been driven from his face. † Also in â€Å"The Red Headed League† Watson says, â€Å"We rattled through an endless labyrinth of gas-lit streets until we emerged into Farrington Street. † These references to gas lamps show that the stories were set in the 1880’s and 1890’s. Conan Doyle also referred to matches in â€Å"The Speckled Band†. Even though we use matches nowadays, we do not use them for the same purposes as in the 1880’s and 1890’s. In those times they were used to see in the dark or to light lanterns. When Helen stoner is talking about what happened to her sister Julia she mentions a match. â€Å"In her right hand was found the charred stump of a match, and in her left a match-box. † This shows that when Julia woke up she struck a match to see what was going on. The value of money in the 1880’s and the 1890’s was much different than the value for money now. At that time people were paid around i 4 a week, which was considered quite a lot of money. Whereas, people now are paid much more and with i 4 you cant really buy much. The social differences in those times also show that these stories were based in the 1880’s and 1890’s. If you look at Helen Stoner, she was a rich woman that lived in a big house with servants. In those times rich people were considered superior to poorer people. Nowadays you wouldn’t find servants working for rich people, because weather your rich or poor you have rights. The audience or readers would recognise the places named in the stories, which are all in England. The intended effect of the writer was to make the reader feel as if he or she was in the story itself, which would make it feel more dramatic. Conan Doyle achieves this by using areas in London that most people live in. Places such as â€Å"Holborn† and â€Å"Harrow†. Sir Arthur Conan Doyle used very unusual titles for his stories to intrigue the reader. When a reader sees the title â€Å"The Speckled Band†, he or she wouldn’t think of a venomous Indian snake. The reader wouldn’t know what to think, which make them want to read the story to see what â€Å"The Speckled Band† is. The same with â€Å"The Red Headed League†, which is a very unusual title. The reader wouldn’t think that that â€Å"The Red Headed League† was a club for read headed people who were paid i 4 a week for copying the â€Å"Encyclopaedia Britannica†. Conan Doyle uses these unusual titles to throw the reader off track. In â€Å"The Speckled band† Conan Doyle makes the reader think that the gypsies are the ones that killed Julia Stoner. He makes it look like all the evidence points to them. Helen Stoner says, â€Å"†¦ perhaps to these very gypsies in the plantation. I do not know whether the spotted handkerchiefs which so many of them wear over their heads might have suggested the strange adjective which she used. † The effect on the reader was that he or she would be thrown off track to make the story feel more interesting. Sir Arthur Conan Doyle uses some very interesting openings to grab the reader’s attention. Also, every character that Conan Doyle introduces is different in some way, which makes the story feel more interesting and also to intrigue the reader.

Running Head:   Film Critique Critique of The Blind Side Tabitha Teasley Eng. 225 Introduction to Film Deborah Cunningham July 13, 2012 Critique of The Blind Side The way a person start in life, will not determine who or what they will become. The Blind Side is based on Micheal Lewis book called, The Blind Side:   Evolution of a game. In this film this young man had a bad life at first. His talents and give him opportunity to had a good ending in life. It do not matter what a person had to go through in life, because it only that one opportunity to make a life time change.This movie involved a boy who was poor and uneducated. He had a bad beginning, but a recruited seen his talents and gave him the chance. Sometime it take someone else to see the talent another person is working with in life. In this film it takes the film director the props, and the lighting to tell this story. As this paper take the story one scene at a time, it will show who it take all element together and it will show that it do not matter how a person start in life. Storytelling is very important in the film world today. Each movie has to start with a story.A story is â€Å"a   narrative; all the elements and events that characters experience, whether before, during, or after the plot that is depicted in a book or a movie† (Film: From Watching to Seeing, 2011) Sometimes the person who wrote the script, will be the director also. If this do not happen, â€Å"it take the writers, producers, the director, and the actors, to put the story into action† (Film: From Watching to Seeing). The storytelling has to have a good story for it to make it to the film world. The director for   this movie is John Lee Hancock. The story of Michael Oher, a homeless and traumatized boy who become an All American football player and first round NFL draft pick with the help of a caring woman and her family† (The Internet Movie Database). The storyteller for the   book â€Å"The Bli nd Side† is Michael Lewis. Critique of The Blind Side â€Å"Lewis today might be the most insider-ish outsider writer alive†(Maine Living, 2011 ). He was raised in New Orleans. He learn is life the â€Å"success and happiness are very different things, never become a lawyer, and you do not need a come from a bookish environment to know how to spin a helluva story† (Maine Living, 2011). The Blind Side expresses a similar theme of how value often is misjudged and overlooked. The improbable true story of how a young, African-American athlete born to a crack-addicted mother was adopted by a rich, evangelical Christian family, it was turned into a popular film featuring an Oscar-winning performance by Sandra Bullock†( Maine Living, 2011). This is a true story about Michael Oher. â€Å"He play for the Baltimore Ravens now† (NPR). He had a very hard childhood. He was a black male who had to start from scratch after being adopt by a family, who had a daughte r† (NPR).He had no identifying documents, school records, or anything that would demonstrate on paper that he existed. â€Å"His whole life changed when his adoptive mom gave him responsibility†(NPR). When a person is bought into a environment that they are not accompany with, it is hard to adopt to the change. For example when the family took him shopping for some clothes, he did not know how to receive them, because he was not used to someone going shopping just for him. Acting is what make the movie come to life. In the textbook, Film: From Watching to Seeing, it states, â€Å"Acting is all about honesty.If you can fake that, you've got it made†. The actor job is to act. They pretends to be the character in the movie. They have to learn their lines and they have to connect with the character they are pretending to be in the film. The starting actor in the movie â€Å"Blind Side† is Quinton Aaron, Sandra Bullock, and Tim McGraw. Critique of The Blind Sid e Aaron was born on August 15, 1984 in Bronx, New York (IMDB). â€Å"His acting began with a Christmas play†(IMDB). He played the character of Michael Oher. He stated that to get ready for this character he had to â€Å"work out twice a day, seven days a week, and he had to loss weight† (IMDB).Sometime actors had to change their appearance to fit the character they got to play. The actors are very important to the movie world. When the movie first came on   it told the story about   Micheal Oher. This allowed the audience to know about the role the character (Quinton Aaron) played. It was on a football field and the point the director wanted the audience focus on was light and the background was dark. When the narrator wanted the audience to focus on a scene the scene stopped while the narrator talked about the scene.The way a person start in life, will not determine who or what they will become. â€Å"Cinematography is the process of photographing motion†( Film: From Watching To Seeing). â€Å"The cinematographer's job is to translate the director's vision for the film, to capture what the director wants to see and to say, and to physically make that happen† (Film: From Watching To Seeing). This is what determines how the audience sees the movie. In the movie â€Å"The Blind Side† the cinematographer used medium long shots and medium close ups. In the scene called â€Å"sleep tight† this   is the shots they used.In this scene the lady was making him a place to sleep at for over night. Medium Long Shot is â€Å"human figures are visible between head-to-toe and head-to-knee in the frame†. Medium close- up is â€Å"human figures are visible head to neck†(Film: From Watching To Seeing). The lighting had a dark background. The lighting was lighter on the area that audiences needed the focus to be on. Critique of The Blind Side Editing is what â€Å"controls what views will see and when the will see it and can profoundly affect how they will interpret a film. It establishes and can manipulate the pacing of s story on the screen.It can assemble a serious of partial details, creating by skillful arrangement the illusion of complete actions and spaces that exist only in the mind of the viewers† (Film: From Watching To Seeing). The movie â€Å"The Blind Side was done in Chronological order. Chronological order makes the movie easy to follow. â€Å" It make the scene unfold one after another, from beginning to end† (Film: Watching To Seeing). Editing is very important to the film world. This is what allow them to put the final touch on the film. They clean the film up so the story can be told.The way a person start in life, will not determine who or what they will become. The sound is also important to the film world. There are three basic categories of film sound. They are dialogue, sound effects, and music. They all have to have balance between the three. Dialogue is â €Å"when the characters talking to one another in the films†. (Film: From Watching To Seeing). Sound effects are used to get the audiences attention. It help draw them into the movie. In the scene â€Å"he's changing Mine†Ã‚   the sound was low and the music was very soft in the background.There were four ladies sitting down eating and they were discussing her adopting the boy. The way the music and the low tone voice kept the focus on the characters. In this movie the sound kept the movie on the serious side. This movie had sounds that would show the sadden and the happy point of it. This was very important in this movie. If the sound be off key, then the movie would not get it point across. They did a good job with the sound and music in this film. It help get the point across with the main point of the movie; The way a person start in life, will not determine who or what they will become.Critique of The Blind Side Directing and style is very important in the movie w orld also. Each director has their own styles. Sometimes the styles maybe black and white, back in the days, and modern days films. In â€Å"The Blind Side† the style were modern days. The choice of which film making techniques to use, and how and when to use them, can define a director's personal style† (Film† Watching To Seeing). The genre for the movie â€Å"The Bind Side† is drama, comedy, sports. I think this fits the movie well. The genre is important because it lets the audience know what to expect in the movie.It described the movies and it allowed the main point of the movie, the way a person start in life, will not determine who or what they will become, to be told on time. Movies can have a positive effect on society or a negative effect. This movie had a positive effect. In the movie The Blind Side the rating from society was good. The movie encourage people. It let society know your dream can come true. It do not matter what you didn't have in your childhood. Life is what a person make it out to be. Look for opportunity, and expect changes to happen at any giving moment. In the movie the boy was seen as this quiet, fat person.Each person has gifts in life. Sometime a person need someone to help pull their gift to it full potential. This lady could have turned her nose up at the young boy, like society did. She had a gift for helping other and she seen the opportunity to use her gift. The movie also taught society to look at a person heart and not the outside appearance of a person. He had a big heart and the lady seen that society was robbing the young boy of his dream. It also taught society that dreams are made to come true. Stop focusing on what a person do not have and give opportunity when they are suppose to be giving.Critique of The Blind Side When her and her friends was having dinner they were making fun of her adopting the young boy. A formalist approach is â€Å"to analysis is concerned with film form, or how the basic elements are organized to convey certain meaning†. This deals with the narrative elements. In the text book, Film: From Watching To Seeing, it states â€Å"the most important thing to remember about film criticism is that any film can be viewed from a variety of perspectives.It may succeed at some and fail at others, but cannot be simply dismissed because the viewer does not like one aspect of it†. Each person will have their own personal conclusion on how they rate a movie. What one may like the next person will dislike. Two people can watch a movie together and each person will have their own points about the movie. It will mean this to one and some completely different to the next person. The point did come across in â€Å"the Blind Side;   the way a person start in life, will not determine who or what they will become.In the movie â€Å"The Blin d Side† everything the director did to make the movie went in together. It took all part to make the movie a success. This movie set out to encourage people about their dreams. From the director to the shoes the character had on, it took it all. There was a balance in the lighting with the sound to the music. It aims to preserve the amount of wealth possible for the intended beneficiaries and flexibility for the individual prior to death. There are further divisions within the real property classification. Traditionally, there are two types of estates: freehold and non-freehold.
